交通事故中的第三者认定，一般情况下是简单明了的。所谓第三者，通常来说，是指某一机动车辆与另一机动车发生事故，从前者所指的机动车辆的保险公司而言，另一机动车辆就是第三者。大多数情形下，这种现象很容易理解第三者的含义，但有一些情形就不容易判断、认定其是否符合第三者。而是否认定为第三者，与保险公司而言，其理赔和承担的责任是不一样的。下面就一些特殊的情形汇总一下：
⒈ 主、挂车在交通事故中相互碰撞，主车和挂车均投保有商业三者险，针对受损的主车，挂车应为其“外界物体”即所说的第三者。主、挂车投保的商业三者险在不同的保险公司，因此挂车的保险公司应当赔偿第三者（主车）的损失。
⒉本车的驾驶员，违章停车，在车前查看车况时，本车被后面的机动车追尾，本车前移过程中，将本车驾驶员碾压受伤死亡，因为驾驶员在车外，且死亡与后面追尾车辆和本车均有因果关系 ，本车所投保有商业第三者险。驾驶员可以由本车车上人员转化第三者。
⒊ 两货车分别为不同的实际车主，但同登订在同一运输公司名下，该两车被保险人均为该运输公司，两货车发生交通事故相撞，对于这种属于同一所有人名下的机动车发生事故，只要能够排除故意制造事故的可能性，保险公司应当认定为受损车辆系另一肇事车辆的第三者。
⒋ 乘车人当车辆倾斜时跳车后，被车辆后斗侧翻顷出的水泥压伤，车上受伤人员不是车辆正常行驶之时的车上人员，因为受伤人员己从车上跳出，伤者应该认定为非车上人员，转化为了第三者的范围。
最高院对第三者与车上人员认定的原则观点：
第三者与车上人员均不是永久固定不变的身份，机动车辆保险合同中所涉及的第三者和车上人员均是在特定时空条件下的临时身份。因保险车辆发生意外事故而受害的人，如果在事故发生前是保险车辆的车上人员，事故发生时已置身于保险车辆之下，则属于“第三者”。至于何种原因导致该人员在事故发生时置身于保险车辆之下，不影响其“第三者”的身份。
