问法网小编获悉，6月5日国家市场监督管理总局发布消息称，对长安福特汽车有限公司实施纵向垄断协议依法作出处罚决定，对长安福特罚款1.628亿元。案情大致为，自2013年始，长安福特在重庆地区采用制定《价格表》、签订《价格自律协议》，以及限定下游经销商向第三人转售的最低价格等方式，严重剥夺了下游经销商的自主定价权，限制了品牌间的正常竞争，损害了市场竞争的公平性和消费者的合法利益。
问法网律师点评：垄断协议不利于市场的公平竞争，损害消费者的合法权益，必须被严惩！
依据《反垄断法》的相关规定，禁止具有竞争关系的经营者达成有关固定价格、限制数量、分割市场、限制新技术、新设备、新产品、联合交易等横向垄断协议。同样，也禁止经营者与交易相对人达成有关固定向第三人转售的价格、限定向第三人转售的最低价格等纵向垄断协议。本案中，长安福特采用制定价表、签订协议、限定下游经销商向第三人转售的最低价格的方式，属于与交易相对人达成纵向垄断协议。并且在调查的过程中，长安福特公司不存在任何豁免情形，因此不能免责。遂，国家市场监督管理总局依据《反垄断法》第46条的规定，责令长安福特停止违法行为，没收其违法所得，并处上一年度销售额1%以上10%以下的罚款。
问法网律师提示您，实践中好多公司以尚未实施所达成的垄断协议为由主张免责，但尚未实施所达成的垄断协议的，市场监管部门仍可对其处以50万元以下的罚款，切勿存在侥幸心理！
