私家车借给他人：

四种情况车主需承担法律责任！

相信有车一族一定经历过“借车”窘境。朋友向你开口借车，你是借还是不借呢？借吧，怕刮着蹭着，不借吧，又觉得面子上挂不住。实际上，随意出借机动车给他人确实要承担很多法律风险，一旦发生事故你可能就要承担赔偿责任。

根据最高人民法院《关于审理道路交通事故损害赔偿案件适用法律若干问题的解释》，遇下面四种情况，借车人也得承担法律责任：

1、 知道或者应当知道机动车存在缺陷，且该缺陷是交通事故发生原因之一的；2、 知道或者应当知道驾驶人无驾驶资格或者未取得相应驾驶资格的；3、 知道或者应当知道驾驶人因饮酒、服用国家管制的精神药品或者麻醉药品，或者患有妨碍安全驾驶机动车的疾病等依法不能驾驶机动车的；4、 其它应当认定机动车所有人或者管理人有过错的。

侵权责任法明确规定，因租赁、借用等情形机动车所有人与使用人不是同一人时，发生交通事故后属于该机动车一方责任的，由保险公司在机动车强制保险责任限额范围内予以赔偿。不足部分，由机动车使用人承担赔偿责任；机动车所有人对损害的发生有过错的，承担相应的赔偿责任。

朋友借车，应该怎样防范风险呢？

一是查“车”。检查自己的车辆是否存在刹车制动不灵、车灯不亮、胎压不均衡等等影响安全行驶的故障，不要让爱车带病出工。如果你的车辆长时间未维护保养，存在隐患可能，也是不能出借的！二是查“照”。查验朋友有没有合法驾照，驾照的准驾车型与车辆是否符合，拿着摩托车照想借小轿车开，那是不可以的！三是查“人”。查验借车人是否能够驾驶，有没有喝酒、有没有吸毒嗑药……大家一起喝酒，切记把你的车钥匙放放好，不要谁问你借都豪爽地掏出来！如果车钥匙随随便便扔在桌上或放在其他很容易被人拿走的地方，也有可能因为未尽到妥善保管的义务而承担责任！

即使借车也要“分人”，借给靠谱的人，心里会很踏实，即使发生了事故，对方于情于理的也会负责到底。切记不可为了一时的面子，发生事后扯皮的事情。
