今天小编就来给大家介绍一下

可以撤销的6种违章情况

1、重复录入/录入错误

同一地点同一时间同一违法行为，出现两次违章，很有可能是重复录入的结果。如果车主收到此类违章，可以提出申诉，撤销多余的违章。

电脑系统会犯错，人工录入也可能犯错，车牌号录入错误也可以申诉。如录入车牌苏 B76XXX，实际应为粤 B76XXX。

2、车辆被套牌

遇到此类情况，车主只需做到：证明这个违章不是你犯的。车辆被套牌是很多车主都深恶痛绝的事情，如果套牌车辆违章了，可以通过车型、驾驶人员等影像资料来证明不是车主自己违章，这种情况的违章也是可以撤销的。

套牌车也分为以下两种：

【类型1】不同车型、同车型不同款、同款不同颜色的套牌。这种套牌车违章处理就相对简单一些，只要车主带上车主的身份证、驾驶证、车辆行驶证、车辆登记证以及涉及违章的车辆进行现场拍照即可。

【类型2】套牌车和本人车辆属于同款、同车型、同颜色。这种情况就需要车主提供被拍违章时，涉及违章的车辆不在现场证明，例如停车票、高速收费票或者监控录像等都是可以的。

3、避让车辆

【类型1】避让故障车、事故车、违章的非机动车或违章停放车辆。

【类型2】避让执行紧急任务的特种车辆（包括警车、消防车、救护车、工程救险车）。

当遇上这两种情况的车辆，行驶过程中因为而不得已压线、掉头、逆行、闯红灯等违章行为，都是可以申请撤消违章的。

4、被大型车遮挡

开车时跟在大货车后面，在驶进路口时，导致闯红灯被拍，可以提出申诉。按照规定，抓拍闯红灯，需具备三张照片：过线、车头、车尾。而在行驶过程中，由于大车的阻挡，小车闯红灯时，车头部位是拍不到的，这也导致了违章拍摄成像其实是无效的。

5、信号灯故障

行车过程中，如果因为交通信号灯的故障（如交通信号灯坏了、不变灯、灯光交替错误等）、或者交警在现场指挥与交通信号指示不一致，而造成车主违章，可以进行申诉。但申诉时需要车主提供交通信号灯故障的证据，可以使用行车记录仪拍下的画面，或者自己手机录的影像画面。

6、抓拍违法记录资料不清晰

电子警察抓拍的违法行为记录资料是处罚的依据，所以资料必须要清晰、准确地反映机动车类型、号牌、外观等特征及违法时间、地点、事实。若车主查询到的违法记录资料不清晰，也是可以申诉的。

除了上述6种情况，车主在汽车被盗抢期间发生的违章、正常行驶被误拍、变更违法行为、标识不明等情况，都可以申诉。

申诉流程

车主注意

1、罚款逾期不交会造成每日罚款金额3%的滞纳金，为避免不必要的麻烦，最好先缴清罚款再进行申诉；

2、车主在填写行政复议申请书时，一定要将违章的来源交待清楚，如果有视频或是第三者的证据更好，然后提交后耐心等待结果。

如果遇到上述情况的违章

一定要先缴清罚款

再带上相关资料、证件

（包括照片、视频等证明属于可撤销违章）

前往当地下属车管所或交警队办理申诉
