机动车闯红灯是非常严重的交通违法行为，根据国家的相关法律规定，闯红灯将受到扣六分、罚款二百元的处罚。那么究竟什么样的行为算是闯红灯呢？当红灯亮起时，我的车刚过停止线，这种情况会被判定为闯红灯吗？
首先我们来看看闯红灯的定义：闯红灯是指机动车、非机动车、行人等违反交通信号灯指示，在所行驶的车道红灯亮起禁止通行时，仍然越过停止线并继续行驶的行为。其实准确来说，关于车辆闯红灯，电子警察一般取证照片为4张，3张车身全景，1张尾部牌照特写照片，用来看清车牌号码。3张全景照片应该分别为：车子未越过停车线，车身一半越过停车线，车身全部驶过停车线。因此，只要4张照片清晰、齐备，违法车辆的相关信息实际上就已经被确认，闯红灯的事情也就基本确定了。
再来说说当红灯亮起时，汽车刚刚越过停止线，这种情况算不算闯红灯。根据闯红灯的定义及要素来看，如果汽车只是前部越过了停止线，但后轮没有过线，然后就停在原地不动了，这种情况是不会算作闯红灯的，一般交通管理部门也不会处罚。
发现闯红灯时，倒车可以不扣分吗？当红灯亮起时，汽车前轮过线，但后轮还在线内，很多人会说，第一张被照了，那么我倒一下总可以吧，千万别，谁动谁犯傻，车辆一旦移动，又触发电子眼给你一张！那就悲剧了，所以，压了停车线停下后，并不算“闯红灯”，但交警可能在路口以“不按规定停车行车”进行处罚。
不论是汽车前部刚过停止线还是全部车身都越过了停止线，一定要记住一点，就是千万不要倒车。一方面在路口倒车非常不安全，很容易与后车追尾；另一方面在城市道路上倒车也是不允许的，特别是在十字路口，很容易被摄像头抓拍。虽然在道路交通安全违法行为中没有具体的处罚规定，但是违章是肯定的。
遇红灯车身全越线停车。如果车辆全身越过停止线后没再继续移动，这样并不算闯红灯。但这种情况是越线停车，根据《道路交通安全违法行为记分分值》第4条第5项，”行经交叉路口不按规定行车或者停车的，一次扣2分。”越线停车后又倒车。机动车不得在铁路道口、交叉路口、单行路、桥梁、急弯、陡坡或者隧道中倒车。如果违规倒车，可处警告或者二十元以上二百元以下罚款。跟大车后”误闯”红灯。驾驶人要保持足够的望范围，要以能看到前方的信号灯、保证安全刹车距离为标准。一般情况下，机动车跟在大型车辆后面被拍，都是因为过路口抢信号。这种行为只能按闯红灯予以处罚。闯黄灯经过路口。交警部门表示，《中华人民共和国道路交通安全法实施条例》规定，路口黄灯闪烁时，已经越过停止线的车辆可以继续通行。如果黄灯已经亮起，还继续抢行通过，那么这样被拍也算闯红灯。交警指挥下闯红灯。当信号灯与交警手势发生冲突时，机动车驾驶人要服从交警的现场指挥。如果因交警现场指挥”被闯红灯”，驾驶人可以到事发地交警大队开具调取证明，免于处罚。当事人若对处罚有异议，可通过行政复议、行政诉讼等渠道申诉解决。
