第一种情形：如果交警的事故认定书上写着你确实不承担事故责任，对方是行人或者非机动车，你又买了交强险，你几乎不需要承担任何费用，如果你没有买交强险，那么这笔钱你要自己掏腰包付给对方。
自己掏腰包也不多，按照强险的佩服标准，11000~12100元左右。 至于那个机动车无责承担10%责任的，如果你能够证明对方是故意撞你找死的，那么，你10%的责任也无需承担。
第二种情形：如果你撞死的人是司机，那么，就没有“无责也要承担10%责任”的说法了，只要按照交强险标准赔付给对方就了事了。
第三种情形：正常行驶无违章不代表就是在事故中没有责任。无责认定非常苛刻，要求司机在正常行驶中遵守交通规则，在遇到突发情况时，采取制动仍未能避免交通事故的发生，则属于完全没有责任。 如果承担次要责任，撞死人会不会被判入刑呢？当然不会。如果连犯罪构成要素都不具备，那么，家属谅解则对你没有任何用处。当然死者为大，交警部门会适当调解，这就要看你自己的善心了。
